1. Acceptance of Terms

By downloading, installing, or using the Kinywa Salama mobile application (the "App"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and the Kinywa Salama Initiative ("we," "our," or "us"), a dental health initiative based in Dar es Salaam, Tanzania.

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement.

2. Description of Service

Kinywa Salama is a dental health information and community platform designed to improve oral health awareness in Tanzania. The App provides:

• Dental health education articles, videos, and news
• A directory of dental clinics and licensed dentists
• Appointment booking with dental professionals
• Community discussion forums on oral health topics
• An AI-powered dental health assistant called Daktari Kinywa
• Online consultation facilitation
• Dental health events and news relevant to Tanzania

The App is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. User Accounts

3.1 Account Registration

To access most features of the App, you must create an account using your phone number, which is verified via a one-time password (OTP). You may also be required to complete a profile with your display name, region, and district.

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. Providing false information may result in suspension or termination of your account.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. If you suspect unauthorised access to your account, please contact us immediately at info@kinywasalama.org.

3.4 Account Termination

You may delete your account at any time from within the App's settings. We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

4. Acceptable Use Policy

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You must NOT:

• Post, share, or upload content that is false, misleading, harmful, abusive, harassing, defamatory, threatening, obscene, or illegal.
• Impersonate any person, dental professional, or organisation.
• Post misinformation about dental health treatments, medications, or procedures.
• Use the App to advertise products or services without our written consent.
• Attempt to gain unauthorised access to other users' accounts or any part of the App's systems.
• Scrape, crawl, or extract App data using automated tools.
• Upload malicious code, viruses, or harmful software.
• Use the AI assistant (Daktari Kinywa) to generate harmful, misleading, or unethical dental or medical advice, or to attempt to circumvent its safety guidelines.
• Harass, bully, or intimidate other users in community forums or discussions.

We reserve the right to remove any content that violates this policy and to suspend or permanently ban accounts of users who do so repeatedly or egregiously.

5. AI Chat Disclaimer

You acknowledge and agree that:

• AI responses may be inaccurate, incomplete, or not applicable to your specific dental condition.
• You should always consult a qualified, licensed dentist before making any decision about your dental health based on information received from the App.
• You will not delay seeking professional dental care because of something Daktari Kinywa told you.
• In a dental or medical emergency, you will contact emergency services or a licensed healthcare provider immediately — not rely on this App.
• The Kinywa Salama Initiative is not liable for any harm, loss, or injury resulting from your reliance on AI-generated responses in the App.

Similarly, all other content in the App — including articles, videos, clinic listings, and community posts — is provided for informational purposes only and is not a substitute for professional dental advice.

6. Intellectual Property

The Kinywa Salama App, including its design, text, graphics, logos, icons, audio/video content, and underlying software, is owned by or licensed to the Kinywa Salama Initiative and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended personal, non-commercial purpose. You must not:

• Copy, reproduce, distribute, or create derivative works of the App's content without our written permission.
• Reverse-engineer, decompile, or disassemble the App's software.
• Remove or alter any copyright, trademark, or proprietary notices.

The "Kinywa Salama" name, logo, and "Daktari Kinywa" name are proprietary to the Kinywa Salama Initiative. All rights reserved.

7. User-Generated Content

7.1 Your Content

Content you create on the App — including your profile photo, display name, community posts, comments, and messages sent to Daktari Kinywa — remains yours. You retain ownership of your content.

7.2 Licence to Us

By posting content on the App, you grant the Kinywa Salama Initiative a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute that content solely for the purpose of operating and improving the App. This licence ends when you delete your content or your account.

7.3 Your Responsibility

You are solely responsible for the content you post. You represent that you have all rights necessary to post your content and that it does not violate any law or third-party rights (including copyright, defamation, or privacy rights).

7.4 Content Moderation

We reserve the right (but not the obligation) to review, edit, or remove any user-generated content that violates these Terms or that we deem inappropriate, at our sole discretion.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Kinywa Salama Initiative and its officers, employees, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of data, revenue, goodwill, or business opportunity.
• Any harm resulting from your reliance on information or AI-generated content in the App.
• Any interruption, suspension, or termination of the App or its services.
• Any third-party actions, including content posted by other users.

Our total liability to you for any claim arising out of or relating to your use of the App shall not exceed the amount you have paid us (if any) in the 12 months prior to the claim. As the App is currently free to use, this limit is zero.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the greatest extent permitted by law.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dar es Salaam, Tanzania. If you have a complaint, we encourage you to contact us first at info@kinywasalama.org so we can try to resolve it amicably.

10. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify you via a push notification or in-app message.

Your continued use of the App after the revised Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.
